These terms and conditions apply to all contracts concerning ClipStage (clipstage.tv) between you and Star Media GmbH, Nottebohmweg 18, 59494 Soest, Germany. The language of the contract is German.

ClipStage creates short films with AI-generated characters, voices, images and music based on your input. In the conversation with the director, you decide what the film should show; from this, the script, test videos (if you wish) and the finished film are created. Each test video and the finished film are separate purchases.

Each purchase is a separate contract. It is concluded when you complete the purchase: for your first purchase, with payment at Stripe; thereafter, by clicking the order button in the app, which charges your stored payment method. If your bank requires an additional confirmation (3-D Secure), the purchase is only completed once this has been given. Before each purchase, you see the price and can abort. After each purchase, you receive the order confirmation with the price and links to the terms and conditions and the withdrawal instructions by email.

A test video costs €9.90. The price of the finished film depends on its length and the package you choose: Basic €1.50, Premium €1.75, Deluxe €2.50 per second, with a minimum of 15 seconds charged. The package stated in the script at the time of purchase applies. If you chose a length in advance, you pay no more than the price for that length; if the film is shorter, correspondingly less. Extras are charged as set out in the price overview on clipstage.tv. If you buy the finished film, half the price of one paid test video for that film is credited against the price of the film; further test videos are not. You pay for each test video and the finished film via Stripe before it is produced. On your first purchase, you enter your payment details with Stripe. Stripe stores your payment method (card, including via Apple Pay or Google Pay, or Link), and every further purchase is paid with it in one click. You can remove it at any time in your account under “Payment methods”; on your next purchase, you then enter payment details again. If the payment is declined, the purchase is not concluded; you can enter a different payment method. No subscription. All prices include VAT. You receive the invoice as a PDF by email after each purchase.

A test video is one scene of your film, about 6 seconds long, in which your character speaks or sings, with a watermark and the label “KI-erzeugt” (AI-generated). It lets you check the character, voice and look. Each test video is paid for separately; when you buy the finished film, half of one test video is credited. You can also order the finished film without a test video.

After the script, you can view a storyboard free of charge: the scenes of your film as still images with voice, music and on-screen text, marked as a storyboard. It serves only as a preview and is not intended for publication. After the finished film, we revise it once free of charge at your request: in doing so, no more than one scene changes (text or image); on-screen text, music and look may change along with it. The character, voice, locations and the other scenes remain as delivered. Larger changes constitute a new film. Your statutory rights in respect of defects remain unaffected.

Test videos and the finished film are available in your account for viewing and downloading. When a test video or the film is ready, you receive an email.

Consumers have a right of withdrawal, see the withdrawal instructions. Because ClipStage produces each test video and the film immediately after payment, before each purchase you expressly consent to our beginning before the withdrawal period expires, and you acknowledge that your right of withdrawal expires once production begins. This also applies if you pay with one click. We confirm your consent to you by email after each purchase.

You may only upload and describe content to which you hold the rights: your own photos, your own premises and brands, and people only with their consent. We do not recreate real people or celebrities — except your own avatar and contributors who have given their consent themselves (see below). If you culpably infringe the rights of third parties with your content, you shall indemnify us against any resulting claims.

You may use the finished film for your own purposes without restriction in time or territory, including for advertising. Every film is labelled in machine-readable form as AI-generated (watermark in image and sound, provenance record according to C2PA). You must not intentionally remove, falsify or circumvent this labelling. If you publish the film, you label it visibly as AI-generated insofar as the AI Act requires this (see AI notice).

Where offered, you can create your own avatar with your face and voice from a live recording (one-off price as set out in the price overview, no subscription). The features included are shown in the app before purchase. The recording is only possible live, may only show you yourself and requires that you are at least 18 years old and give your consent in the recording. You can delete your avatar at any time; it is also deleted along with your account.

You can invite other people to a film as contributors. Only invite people who want to take part, and only provide names and email addresses that you are permitted to use for this purpose. We only include the face of a real person once they have recorded themselves live and given their consent, and only in this one film; we do not use their voice. The person can withdraw their consent at any time, after which they are no longer included in any scene. Portrayals of contributors that demean them, deceive about them or break the law are prohibited. We do not carry out such requests. Films with contributors visibly carry the EU symbol “AI generated” from the outset. If you switch it off and publish the film, you are responsible for labelling it as AI-generated in the way the AI Act requires. If you culpably infringe the rights of contributors, you shall indemnify us against any resulting claims.

Where offered, you can take out the “My Avatar” subscription for your own avatar: €2.90 per month or €29 per year, including VAT. As long as the subscription runs, your avatar remains stored and you receive a 10% discount on every finished film. Without a subscription, we delete your avatar twelve months after your last film; we remind you by email beforehand. The monthly subscription renews by one month at a time until you cancel it. The annual subscription runs for twelve months and then continues as a monthly subscription for €2.90. You can cancel at any time with effect from the end of the paid period: in your account or without signing in via “Cancel contracts here” (clipstage.tv/en/kuendigen). We confirm every cancellation by email. The amount is debited from your payment method via Stripe at the start of each period; you receive an invoice by email for every debit. The right to extraordinary termination remains unaffected.

The statutory rights in respect of defects apply. With a test video, you can see how the finished film will come across before it is made, and discuss changes with the director.

We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the Produkthaftungsgesetz (German Product Liability Act) and to the extent of any guarantee we have given. In cases of slight negligence, we are only liable for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely —, limited to the damage that was foreseeable and typical for this type of contract at the time the contract was concluded. Otherwise, liability is excluded.

You can delete your account at any time under “Your account”. This permanently deletes your films, uploads, saved characters and avatars. Download finished films beforehand.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is Soest. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
